RECENT LEGISLATION:

2024
  • HB-1090 allows evidence of failure to comply with passenger restraint system statutes to be admitted in a civil action.
  • HB-1162 removes civil liability for a tort claim based on the failure to install optional equipment on a commercial motor vehicle.

​2023
  • HB-1001 (State Budget) – Assigns a member of the Indiana Motor Truck Association to the Funding Indiana’s Roads for a Stronger, Safer Tomorrow (FIRSST) Committee.
  • HB-1050
    • Establishes International Fuel Tax Agreement (IFTA) based model for collecting road use revenue from alternative fuel vehicles.
    • Removes the requirement for intrastate carriers to register, pay, sticker and quarterly report their diesel fuel purchases.
  • HB-1124 – Requires transparency when a third party is financing a lawsuit.
  • HB-1196 – Requires all CDL training schools to expose all students to the perils of human trafficking through a 30-minute video.
  • HB-1204 – Removes onerous overweight load civil penalties and establishes reasonable enforcement statutes.
 
2021
  • HB-1190
    • Removes the commodity list allowed for overweight divisible loads.
    • Adds 8,500 single-trip permits for loads above 2.4 ESALs (equivalent single-axle loads).
  • HB-1150 – Reduces the “Lookback” on issuing civil penalties for overweight loads from three years to one year.
 
2020
  • HB-1070 – Prohibits the use of handheld electronic devices while driving.
  • HB-1301 – Allows deployment of safety equipment to commercial vehicles without jeopardizing the independent contractor model
 
2018
  • HB-1290
    • Allows truck “platoon” testing in Indiana.
    • Combines the diesel “surcharge” with the special tax so carriers only pay one tax on diesel.
    • Apportions the transportation infrastructure improvement fee (TIIF) for all International Registration Plan (IRP)-registered vehicles.
2017
  • HB-1002 (Budget Bill)
    • Eliminates sales tax on private carrier diesel.
    • Gas tax increases by 10 cents per gallon and moves from general fund to road fund.
    • Special fuel (diesel) tax increases by 20 cents per gallon (10 cents on diesel plus 10 cents on surcharge).
    • Establishes diesel surcharge placed on pump and collected at point of sale.
    • The 37 counties that had a non-apportioned wheel tax will now be apportioned.
    • Electric-powered vehicles will now pay $150 registration fee.
    • Hybrid vehicles will now pay $50 registration fee.
    • Removes $8.75 trailer registration renewal fee.
  • HB-1039 – Allows tractor trailers the right of way in roundabouts.
  • HB-1447 – Removes the ability for the BMV to assess 4 points to a driver’s CDL when found to be hauling an unpermitted overweight load.
  • SB-275 – Removes the requirement that an individual must be an Indiana resident to qualify for an Indiana CDL.
 
2015
  • HB-1025 – Allows an individual to have a hearing with the Bureau of Motor Vehicles (BMV) in order to clear their driving violations from other states.
  • HB-1393 – Allows a commercial driver’s license (CDL) to be issued in a different state from where the CDL training took place.
  • SB-173 – Includes both CDL training and diesel mechanic training as listed vocations for the training of minimum-security inmates.
  • SB-361 – Removes liability of the propane carrier for leaks and explosions at the delivery site.
  • SB-437 – Avoids total ban of “Jake Brake” usage. Requires “Jake Brakes” to have a muffler in good working order.
 
2014
  • HB-1180 – Makes improvements to HB-1324 from the 2013 session to provide balance and fairness to natural gas vehicle tax credit distribution.
 
2013
  • HB-1324 – Provides a $15,000 tax credit to a company that purchases a truck powered by natural gas.
  • HB-1545 – Allocates $10 million per year for distribution to companies for logistics investments.
  • HB-1481 – Allows steel coils to be considered a “divisible load.” The metal commodities’ weight limit increases to 120,000 pounds. The agricultural commodities’ weight limit increases to 97,000 pounds.
  • SB-11 – Allows 57-foot trailers to be used for motorsports transportation.
  • SB-242 – Transfers the responsibility of notifying the state of radioactive shipments from the carrier to the shipper
